‘White Collar’ Rule Closer to Becoming Finalized

The Department of Labor March 14 sent the final “White Collar” rule to the White House Office of Management and Budget (OMB) for review. Typically, OMB can take up to three months of review before the final rule is published. After publication, employers will have 60 days to comply with the rule. Under the Congressional Review Act, Congress can evaluate the rule before it goes into effect during those 60 days. Congress does have the option to vote on a resolution of disapproval to nullify the rule; however, President Obama would then most likely exercise his veto power.

It is apparent DOL is moving expeditiously which means if the proposed rule is implemented, employers will have a very short timeline to comply. Argentum encourages you to plan and prepare for the proposed rule, as it could go into effect as early as mid-June to mid-July 2016. The rule applies to all employers regardless of size.
